Résumé Omnilex

The Swiss Federal Supreme Court did not enter into the appellant’s recusal request, finding it abusive and aimed only at obstructing justice. It also did not enter into the federal appeal because the Bern High Court decision of 9 August 2012 had been served on 16 August 2012 and the appeal was posted only on 18 September 2012, after the 30-day deadline expired. Because the appeal was hopeless, the request for free legal aid was denied. Court costs of CHF 500 were imposed on the appellant.

Regeste Omnilex

Art. 100 Abs. 1, 48 Abs. 1 and 45 Abs. 1 BGG; Art. 108 Abs. 1 lit. a BGG; Art. 64 Abs. 1 BGG, Art. 66 Abs. 1 BGG: A federal appeal lodged after expiry of the 30-day time limit is manifestly inadmissible and may be disposed of in simplified proceedings without entering into the merits. A recusal motion filed solely to obstruct proceedings is abusive and likewise inadmissible; prior participation of the judge in earlier decisions does not, absent additional elements, create an appearance of bias. Legal aid is refused where the appeal lacks any prospect of success; costs are borne by the unsuccessful party.

Urteil vom 20. September 2012
II. zivilrechtliche Abteilung

Besetzung
Bundesrichterin Hohl, Präsidentin,
Gerichtsschreiber Füllemann.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Z.________,
Beschwerdegegner.

Gegenstand
Ausstand, unentgeltliche Rechtspflege, Revision (Eheschutz etc.).

Beschwerde nach Art. 72 ff. BGG gegen den Entscheid vom 9. August 2012 des Obergerichts des Kantons Bern (Zivilabteilung, 2. Zivilkammer).

Nach Einsicht
in die Beschwerde gemäss Art. 72 ff. BGG gegen den Entscheid vom 9. August 2012 des Obergerichts des Kantons Bern (ZK 12 440 und 442),

in Erwägung,

Lausanne, 20. September 2012
