Résumé Omnilex

A. appealed to the Federal Supreme Court against a cantonal judgment confirming an heir certificate that also named B. as heir. The appeal was mailed on 29 January 2013, but the deadline expired on 28 January 2013. The Court held that the filing was late, because the decision had been notified on 28 December 2012 and the Christmas judicial recess does not apply in proceedings concerning interim measures under Art. 98 LTF. The appeal was therefore not entered upon in simplified procedure, the request for suspensive effect became moot, and costs of CHF 500 were imposed on A.

Regeste Omnilex

Art. 100 cpv. 1, 44 cpv. 1, 45 cpv. 1, 46 cpv. 2, 48 cpv. 1, 108 cpv. 1 lett. a LTF; timeliness of the appeal and non-entry for manifest inadmissibility. In proceedings falling under Art. 98 LTF, the suspension of deadlines from 18 December to 2 January is excluded by Art. 46 cpv. 2 LTF. The appeal period runs from the day following notification; if the last day falls on a Sunday or public holiday, it extends to the next business day. Submission to the post only on the following day is late. In such a case, the President may decide non-entry in simplified proceedings, and ancillary requests, such as suspensive effect, become moot; costs follow the losing party under Art. 66 cpv. 1 LTF.

Sentenza del 4 febbraio 2013
II Corte di diritto civile

Composizione
Giudice federale von Werdt, Presidente,
Cancelliera Antonini.

Partecipanti al procedimento
A.________,
patrocinata dall'avv. Andrea Pozzi,
ricorrente,

contro

B.________,
rappresentato dal tutore ufficiale Tiziano Belloni,
opponente.

Oggetto
rilascio di certificato ereditario,

ricorso contro la sentenza emanata il 19 dicembre 2012 dalla I Camera civile del Tribunale d'appello del
Cantone Ticino.

Considerando:
che statuendo il 16 luglio 2009 il Pretore del Distretto di Lugano ha deciso il rilascio del certificato ereditario nella successione fu C.________ nel quale sarebbe figurato anche B.________ quale erede;
che con sentenza 19 dicembre 2012 la I Camera civile del Tribunale d'appello del Cantone Ticino ha respinto un appello di A.________ - con il quale ella chiedeva la modifica del certificato ereditario nel senso di escludere quale erede B.________ - e confermato la decisione pretorile;
che con ricorso in materia civile 29 gennaio 2013 A.________ è insorta al Tribunale federale, postulando pure la concessione dell'effetto sospensivo al gravame;
che il ricorso contro una decisione deve essere depositato presso il Tribunale federale entro trenta giorni dalla notificazione del testo integrale della decisione (art. 100 cpv. 1 LTF);
che il termine decorre dal giorno successivo alla notificazione (art. 44 cpv. 1 LTF);

che se l'ultimo giorno del termine è un sabato, una domenica o un giorno riconosciuto festivo dal diritto federale o cantonale, il termine scade il primo giorno feriale seguente (art. 45 cpv. 1 LTF);

che gli atti scritti devono essere consegnati al Tribunale federale oppure, all'indirizzo di questo, alla posta svizzera o a una rappresentanza diplomatica o consolare svizzera al più tardi l'ultimo giorno del termine (art. 48 cpv. 1 LTF);
che nei procedimenti che concernono, come in concreto, delle misure cautelari ai sensi dell'art. 98 LTF (v. sentenze 5A_495/2010 del 10 gennaio 2011 consid. 1.2; 5A_162/2007 del 16 luglio 2007 consid. 5.2; FABIENNE HOHL, Procédure civile, vol. II, 2a ed. 2010, n. 3072 pag. 545) non si applica la sospensione dei termini dal 18 dicembre al 2 gennaio incluso prevista dall'art. 46 cpv. 1 lett. c LTF (art. 46 cpv. 2 LTF);

che la decisione impugnata è stata intimata il 27 dicembre 2012 e notificata alla ricorrente il 28 dicembre 2012;

che il termine per adire il Tribunale federale ha quindi cominciato a decorrere il 29 dicembre 2012 per scadere il 27 gennaio 2013;
che, essendo il 27 gennaio 2013 una domenica, l'ultimo giorno utile per il deposito del ricorso era lunedì 28 gennaio 2013;

che in queste circostanze il rimedio consegnato alla posta svizzera il 29 gennaio 2013 (data del timbro postale) si appalesa tardivo e quindi inammissibile;
che giusta l'art. 108 cpv. 1 lett. a LTF il Presidente della Corte decide in procedura semplificata la non entrata nel merito su ricorsi manifestamente inammissibili;
che con l'evasione del gravame l'istanza tendente al conferimento dell'effetto sospensivo diviene priva d'oggetto;
che le spese giudiziarie seguono la soccombenza (art. 66 cpv. 1 LTF);

per questi motivi, il Presidente pronuncia:

1.
Il ricorso è inammissibile.

2.
Le spese giudiziarie di fr. 500.-- sono poste a carico della ricorrente.

3.
Comunicazione alle parti e alla I Camera civile del Tribunale d'appello del Cantone Ticino.

Losanna, 4 febbraio 2013

Question juridique clé

Whether the civil appeal to the Federal Supreme Court was filed within the statutory time limit.

Solution extraite

No. The 30-day deadline expired on 2013-01-28, while the appeal was handed to the Swiss Post on 2013-01-29.

Motifs extraits

The challenged decision was notified on 2012-12-28; the deadline ran from 2012-12-29. Because 2013-01-27 was a Sunday, the last day was postponed to Monday 2013-01-28. In matters under Art. 98 LTF, the suspension of deadlines from 18 December to 2 January does not apply.

Question juridique clé

Whether the request for suspensive effect could still be examined.

Solution extraite

No; it became moot once the appeal was not entered upon.

Motifs extraits

After dismissal of the appeal as inadmissible, the request for suspensive effect no longer had an object.

Question juridique clé

Allocation of court costs.

Solution extraite

The appellant must bear the court costs of CHF 500.

Motifs extraits

Costs follow the losing party under Art. 66(1) LTF.
