Résumé Omnilex

The Federal Supreme Court, in simplified procedure, declared the constitutional appeal inadmissible against a cantonal decision upholding definitive lifting of opposition in debt enforcement. The appellant failed to comply with the federal reasoning requirements and did not meaningfully address the cantonal court's grounds. The Court also observed that any criminal complaint against the cantonal judges had to be dealt with by the competent cantonal authorities, and it noted abusive litigation conduct. Court costs of CHF 200 were charged to the appellant.

Regeste Omnilex

Art. 116, 117 and 106 para. 2 LTF; admissibility of a constitutional appeal requires a clear, reasoned challenge to the decisive grounds of the cantonal decision. A mere reference to grievances or collateral allegations, including complaints against judges outside the Court's competence, does not satisfy the minimum reasoning standard. Where the submission is manifestly deficient or abusive, the Federal Supreme Court may decline to enter under the simplified procedure of Art. 117 in conjunction with Art. 108 para. 1 lit. a-c LTF; costs follow the event under Art. 66 para. 1 LTF.

Objet
mainlevée d'opposition,

recours constitutionnel contre l'arrêt de la Cour des poursuites et faillites du Tribunal cantonal du canton de Vaud du 7 juin 2013.

Considérant:

que, par arrêt du 7 juin 2013, la Cour des poursuites et faillites du Tribunal cantonal du canton de Vaud a rejeté le recours déposé par le recourant contre le prononcé du Juge de paix du district de l'Ouest lausannois prononçant la mainlevée définitive, à concurrence de xxx fr., xxx fr. et xxx fr. plus intérêts à 5% dès le 1er décembre 2012, de l'opposition qu'il avait formée dans le cadre d'une poursuite initiée à l'instance de l'intimé;
que l'arrêt entrepris retient que les créances invoquées par l'intimé se fondaient sur des arrêts exécutoires, que les arguments du recourant contre la mainlevée étaient sans pertinence et qu'il n'invoquait aucun moyen qui pourrait justifier sa libération;
que le recours constitutionnel ne satisfait pas aux exigences des art. 116 et 117/106 al. 2 LTF, le recourant ne s'en prenant pas de manière compréhensible aux considérants du Tribunal cantonal;
que, dans la mesure où l'intéressé dépose plainte pénale contre les juges cantonaux, seules les autorités cantonales seraient compétentes pour en traiter;
qu'à cela s'ajoute qu'une fois de plus, le recourant procède de manière abusive (art. 42 al. 7 LTF);
que, dans ces conditions, il convient de déclarer son recours irrecevable selon la procédure simplifiée prévue aux art. 117 et 108 al. 1 let. a à c LTF;
que les frais judiciaires doivent être mis à la charge du recourant (art. 66 al. 1 LTF);
que toute nouvelle écriture du même genre dans cette affaire, notamment une demande de révision abusive, sera classée sans réponse;

par ces motifs, le Président prononce:

1.

Le recours est irrecevable.

2.

Question juridique clé

Whether the constitutional appeal met the Federal Supreme Court's reasoning requirements.

Solution extraite

No. The appeal did not challenge the cantonal reasoning in an understandable manner and therefore could not be examined on the merits.

Motifs extraits

A constitutional appeal must satisfy Arts. 116 and 117 in conjunction with Art. 106 para. 2 LTF; the appellant failed to address the decisive reasons of the cantonal judgment.

Question juridique clé

Whether the appellant's complaint against the cantonal judges affected federal jurisdiction.

Solution extraite

No. Any criminal complaint against cantonal judges had to be handled by the competent cantonal authorities.

Motifs extraits

The Federal Supreme Court noted it was not the competent instance for such a complaint.

Question juridique clé

Allocation of court costs.

Solution extraite

Court costs were charged to the appellant.

Motifs extraits

Because the appeal was inadmissible and abusive conduct was noted, costs followed the outcome under Art. 66 para. 1 LTF.
