The Federal Supreme Court dealt with a constitutional complaint against an Aargau cantonal appellate judgment in a bankruptcy collocation dispute. Because, in a related appeal decided the same day, the Court had already upheld the appellant on the only point challenged by the constitutional complaint, the matter no longer presented a live controversy. The complaint was therefore struck as moot. In accordance with settled practice, the appellant was ordered to pay a reduced court fee of CHF 500.

Sachverhalt:

Mit Urteil vom 20. März 2002 hat der Präsident des Bezirksgerichts Zofingen die Kollokationsklage des Beschwerdeführers im Konkurs der Y.________ AG abgewiesen, soweit er darauf eingetreten ist. Die dagegen erhobene Appellation hat das Obergericht des Kantons Aargau, 1. Zivilkammer, mit Urteil vom 1. Juli 2003 abgewiesen.

Dagegen hat der Beschwerdeführer am 23. September 2003 staatsrechtliche Beschwerde und Berufung eingereicht. Zur staatsrechtlichen Beschwerde sind keine Vernehmlassungen eingeholt worden.

Das Bundesgericht zieht in Erwägung:

Im angefochtenen Entscheid geht es einerseits um die Frage, ob der Beschwerdeführer am 25. Mai 2001 mit einer Klage die Kollokation der Sparkasse A.________ im Konkursverfahren der Y.________ AG anfechten durfte, und andererseits um diejenige, ob seine Lohnforderung in der 1. statt in der 3. Klasse zu kollozieren ist.

Mit Entscheid heutigen Datums hat die II. Zivilkammer im konnexen Berufungsentscheid die erste Streitfrage im Sinne des Beschwerdeführers gutgeheissen und das angefochtene Urteil diesbezüglich aufgehoben. Damit ist die sich einzig auf diesen Streitpunkt beziehende staatsrechtliche Beschwerde gegenstandslos geworden.
2.
Bei Gegenstandslosigkeit wird dem Beschwerdeführer nach ständiger Praxis eine reduzierte Gerichtsgebühr auferlegt.

Demnach beschliesst das Bundesgericht:
1.
Die staatsrechtliche Beschwerde wird als gegenstandslos abgeschrieben.
2.
Die Gerichtsgebühr von Fr. 500.-- wird dem Beschwerdeführer auferlegt.
3.
Dieser Beschluss wird den Parteien und dem Obergericht des Kantons Aargau, 1. Zivilkammer, schriftlich mitgeteilt.
