The insurer lodged a public-law appeal against a cantonal civil judgment, while also pursuing a reform appeal. The Federal Supreme Court decided the reform appeal first and substituted the cantonal judgment with a new merits decision. As a result, the public-law appeal had become moot and was struck from the docket. The Court ordered the appellant to pay a judicial fee of CHF 2,000 under Art. 156(1) OJ and awarded no costs to the respondent, who had not been invited to file observations.
Art. 156 al. 1 OJ; when a parallel reform appeal leads to a new merits decision replacing the contested cantonal judgment, a pending public-law appeal against that judgment becomes moot and is stricken from the roll. In such a case, costs may nevertheless be charged to the appellant under Art. 156 al. 1 OJ; no party compensation is due to the respondent if no response was requested.

que, statuant en premier lieu sur le recours en réforme par arrêt de ce jour (5C.2/2007), la cour de céans l'a admis, en rendant sur le fond une nouvelle décision qui s'est substituée au jugement attaqué,
que le recours de droit public est ainsi devenu sans objet,
qu'au vu de l'art. 156 al. 1 OJ, la recourante supportera les frais de la procédure,
qu'il n'y a pas lieu d'allouer d'indemnité de dépens à l'intimé qui n'a pas été invité à répondre.
Par ces motifs, le Tribunal fédéral prononce:

Le recours est sans objet et la cause est rayée du rôle.
2.
Un émolument judiciaire de 2'000 fr. est mis à la charge de la recourante.
3.
Le présent arrêt est communiqué en copie aux mandataires des parties et à la Cour civile du Tribunal cantonal du canton de Vaud.

Because the Federal Supreme Court had already decided the reform appeal and issued a new merits decision substituting the challenged judgment, there was no longer an object for the public-law appeal.
