Résumé Omnilex

The appellant challenged a Zurich cantonal ruling on costs and compensation after a discontinued criminal investigation. The Federal Supreme Court held that the appeal did not contain any proper request on the merits and did not address the contested decision, but merely presented the appellant's own account. Because the submission did not satisfy Art. 42 paras. 1 and 2 BGG, the Court did not enter into the appeal under Art. 108 BGG. Court costs were exceptionally waived.

Regeste Omnilex

Art. 42 paras. 1 and 2 BGG; Art. 108 BGG; admissibility of a Federal Supreme Court appeal. An appeal must contain a clear substantive request and a reasoned critique of the contested decision. A merely narrative submission, or one that seeks only the Court's 'opinion' without stating in what respect the lower-court judgment is to be altered, does not meet the minimum reasoning requirements and is inadmissible. In such a case, the Court may issue a non-entry decision under Art. 108 BGG; costs may exceptionally be waived.

Urteil vom 28. Februar 2013
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Florhofgasse 2, 8001 Zürich,
Beschwerdegegnerin.

Gegenstand
Einstellungsverfügung (Kosten- und Entschädigungsfolgen),

Beschwerde gegen den Beschluss des Obergerichts
des Kantons Zürich, III. Strafkammer,
vom 27. Dezember 2012.

Der Einzelrichter zieht in Erwägung:

1.

2.
Ausnahmsweise kann auf eine Kostenauflage verzichtet werden.

Demnach erkennt der Einzelrichter:

1.
Auf die Beschwerde wird nicht eingetreten.

2.
Es werden keine Gerichtskosten erhoben.

3.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, III. Strafkammer, schriftlich mitgeteilt.

No. The appellant did not formulate any substantive request showing how the contested decision should be changed and failed to engage with the cantonal ruling.

Motifs extraits

The submission merely asked for the Court's 'opinion' and recounted the matter from the appellant's perspective. This does not meet the requirements for a reasoned appeal under Art. 42 paras. 1 and 2 BGG.

Question juridique clé

Whether court costs should be levied despite non-entry

Solution extraite

No court costs were charged exceptionally.

Motifs extraits

The Court exercised discretion to waive costs in this case.
