Résumé Omnilex

X. appealed to the Federal Court against a Vaud cantonal decision confirming the inadmissibility of his opposition to a penal order. The Federal Court held that he did not engage with the cantonal reasoning and did not demonstrate a violation of federal law or arbitrariness in the facts. The appeal was therefore inadmissible. Because the appeal had no prospects of success, legal aid was refused, and reduced court costs of CHF 500 were imposed on X.

Regeste Omnilex

Art. 42 al. 2, 97 al. 1 and 108 al. 1 let. b LTF; inadmissibility of an appeal for insufficient motivation. The appellant must specifically address the reasons of the contested decision and show, by reasoned argument, which federal law provisions were violated; mere assertion is insufficient. Where the factual findings are challenged, arbitrariness must be substantiated within the meaning of Art. 97 al. 1 LTF. Failing such motivation, the appeal is summarily set aside under Art. 108 al. 1 let. b LTF. Legal aid under Art. 64 al. 1 LTF is unavailable when the appeal is manifestly devoid of prospects of success; costs are then borne by the appellant under Art. 66 al. 1 LTF, possibly reduced according to financial circumstances.

Objet

Question juridique clé

Whether the criminal appeal met the Federal Court's motivation requirements.

Solution extraite

The appeal did not address the cantonal court's reasoning and did not show any violation of law or arbitrariness in the facts.

Motifs extraits

Under Art. 42 para. 2 LTF and Art. 97 para. 1 LTF, the appellant had to challenge the contested reasoning specifically and substantiate factual arbitrariness; he failed to do so, so the appeal was inadmissible under Art. 108 para. 1 let. b LTF.

Question juridique clé

Whether legal aid should be granted.

Solution extraite

Legal aid was refused because the appeal had no prospects of success.

Motifs extraits

Since the claims were doomed from the outset, the statutory condition of non-futility for legal aid was not met.

Question juridique clé

Who bears the court costs.

Solution extraite

The appellant had to bear the reduced court costs in light of his financial situation.

Motifs extraits

As the appeal was inadmissible and legal aid was refused, costs were imposed on the appellant under Art. 66 para. 1 LTF.
