Résumé Omnilex

The appellant challenged the cantonal prosecutor’s dismissal of his criminal complaint against a court clerk allegedly for breach of official secrecy. The Federal Supreme Court held that he lacked standing under Art. 81 BGG because he was neither a private prosecutor nor a victim and had no legally protected interest. It also held that his blanket allegation of violated party rights did not satisfy the substantiation requirements of Arts. 42 and 106 BGG. The court therefore did not enter into the complaint, denied legal aid for lack of prospects, and imposed reduced court costs of CHF 500 on the appellant.

Regeste Omnilex

Art. 81 BGG; Art. 42, 106 Abs. 2, 64 Abs. 1, 66 Abs. 1 BGG; criminal appeal against a cantonal discontinuance decision: standing and substantiation requirements. A complainant who is neither private prosecutor nor victim, and who otherwise lacks a legally protected interest in the annulment or amendment of the challenged decision, has no standing in criminal matters. Independent of standing, constitutional and cantonal-law complaints must be expressly raised and reasoned; a merely generic allegation of denial of justice does not meet the requirements of Art. 42 and 106 Abs. 2 BGG. An obviously hopeless appeal excludes legal aid under Art. 64 Abs. 1 BGG; costs are borne by the unsuccessful appellant under Art. 66 Abs. 1 BGG, with possible reduction according to financial circumstances.

Urteil vom 8. Februar 2008
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Willisegger.

Parteien
X.________,
Beschwerdeführer,

gegen

Verhöramt des Kantons Appenzell A.Rh., Rathaus, 9043 Trogen,
Beschwerdegegner.

Gegenstand
Einstellung des Strafverfahrens (Verletzung des Amtsgeheimnisses),

Beschwerde gegen den Entscheid der Staatsanwaltschaft des Kantons Appenzell A.Rh. vom 26. November 2007.

Der Präsident zieht in Erwägung:

1.

BGE 128 I 218 E. 1.1 S. 220). 106 BGG in keiner Weise.

Question juridique clé

Whether the appellant had standing to challenge the cantonal decision under Art. 81 BGG.

Solution extraite

He lacked standing because he was neither a private prosecutor, victim, nor otherwise legally protected in the sense required by Art. 81 BGG.

Motifs extraits

The court found no legally protected interest in the annulment or amendment of the challenged decision and therefore no entitlement to file the criminal appeal.

Question juridique clé

Whether the complaint met the minimum reasoning requirements for alleging violations of party rights and fundamental rights.

Solution extraite

No. The appellant merely asserted a general violation of party rights without identifying a legal norm or explaining any formal denial of justice.

Motifs extraits

Under Arts. 42 and 106 BGG, grievances concerning fundamental rights or cantonal law must be specifically raised and reasoned; a blanket allegation is insufficient.

Question juridique clé

Whether legal aid should be granted.

Solution extraite

Legal aid was refused because the appeal had no prospects of success.

Motifs extraits

An obviously inadmissible appeal is hopeless and does not justify free legal assistance under Art. 64 BGG.

Question juridique clé

Allocation of court costs.

Solution extraite

Court costs were imposed on the appellant, reduced in view of his strained financial situation.

Motifs extraits

As the appeal failed, the costs followed the outcome, but the amount was lowered because of financial hardship.
