Résumé Omnilex

The Federal Supreme Court, acting through its president in summary procedure, held that the criminal appeal was inadmissible because the initial filing contained neither a request nor reasons and the later supplement was submitted after the deadline. The court therefore declined to hear the appeal under Art. 108 BGG and ordered the appellant to pay CHF 800 in court costs.

Regeste Omnilex

Art. 42 Abs. 1-2, Art. 48 Abs. 1, Art. 100 Abs. 1 and Art. 108 BGG; admissibility of an appeal to the Federal Supreme Court. An appeal must be filed within 30 days and, to be valid, must contain a specific request and reasoning. A filing that omits these essential elements does not preserve the appeal period; a subsequent supplement can cure the defect only if it is timely. If the request and reasons are absent in the initial filing and the supplement is late, summary non-entry is warranted. Costs are borne by the unsuccessful appellant under Art. 66 Abs. 1 BGG.

Urteil vom 4. Juli 2014

Strafrechtliche Abteilung

Besetzung
Bundesrichter Mathys, Präsident,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
vertreten durch Rechtsanwalt Siegfried Spatzl,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Graubünden, Leitender Staatsanwalt,
Beschwerdegegnerin.

Gegenstand

Strafkammer, schriftlich mitgeteilt.

Lausanne, 4. Juli 2014

Question juridique clé

Whether the appeal met the formal and time-limit requirements for admissibility before the Federal Supreme Court.

Solution extraite

The appeal did not satisfy the statutory requirements: the initial filing lacked a request and reasoning, and the later supplement was filed out of time.

Motifs extraits

Under Arts. 100(1), 48(1), and 42(1)-(2) BGG, an appeal must be filed within 30 days and contain both a request and reasons. The first filing was incomplete, and the corrective submission was late; therefore summary non-entry under Art. 108 BGG was appropriate.

Question juridique clé

Allocation of federal court costs.

Solution extraite

Court costs were imposed on the appellant.

Motifs extraits

As the appellant failed, the costs followed the outcome pursuant to Art. 66(1) BGG.
