The Federal Supreme Court dealt with a criminal complaint against a cantonal non-entry decision. It held that the appellant had not shown which cassation grounds he had raised before the cantonal court or why the cantonal court had to address his arguments. The lower court’s main reasoning was therefore not arbitrary, and the complaint was not entered into under Art. 108 BGG. The appellant was ordered to pay the federal court fee of CHF 800.

Der Präsident zieht in Erwägung:

Die Vorinstanz ist in ihrer Haupterwägung auf eine kantonale Beschwerde des Beschwerdeführers nicht eingetreten, weil er nicht darlege, inwiefern das amtsgerichtliche Urteil an einem der in § 246 StPO/LU angeführten Kassationsgründe leide. Er setze sich mit der Begründung des amtsgerichtlichen Urteils nicht auseinander. Vielmehr lege er in appellatorischer Weise einfach seine Sicht der Dinge dar (angefochtener Entscheid S. 4 E. 2.2.). Der Beschwerdeführer macht geltend, damit habe die Vorinstanz das kantonale Verfahrensrecht willkürlich angewendet. Für sie sei ohne weiteres erkennbar gewesen, welche Punkte des amtsgerichtlichen Urteils er mit seiner Beschwerde angefochten habe. Er habe sich damit auch rechtsgenüglich auseinandergesetzt (Beschwerde S. 2). Er sagt indessen nicht, welche Kassationsgründe er in seiner kantonalen Beschwerde genannt und inwiefern er deren Vorliegen begründet hat, so dass das Bundesgericht prüfen könnte, ob die Vorinstanz diese Punkte hätte behandeln müssen. Aus dem Umstand, dass die Vorinstanz in einer Eventualerwägung auch noch materiell auf seine Beschwerde eingegangen ist, folgt nicht, dass die Beschwerde eigentlich hinreichend begründet gewesen wäre. Dass er keinen Rechtsvertreter hatte, vermag ebenfalls keine willkürliche Anwendung des kantonalen Verfahrensrechts darzutun. Die Haupterwägung der Vorinstanz erweist sich nicht als rechtswidrig, weshalb sich das Bundesgericht mit der Eventualerwägung nicht befassen kann. Auf die Beschwerde ist im Verfahren nach Art. 108 BGG nicht einzutreten.

Die Gerichtskosten sind dem Beschwerdeführer aufzuerlegen (Art. 66 Abs. 1 BGG).
Demnach erkennt der Präsident:

Auf die Beschwerde wird nicht eingetreten.

2.
Die Gerichtsgebühr von Fr. 800.-- wird dem Beschwerdeführer auferlegt.

3.
Dieses Urteil wird dem Beschwerdeführer, der Staatsanwaltschaft des Kantons Luzern und dem Obergericht des Kantons Luzern, II. Kammer, schriftlich mitgeteilt.
