The appellant withdrew his criminal-law appeal by letter of 25 October 2007. The President of the Criminal Division of the Federal Supreme Court therefore ordered the appeal struck from the docket under Art. 32(2) BGG and decided that no costs would be charged. The order was communicated to the appellant, the Zurich Office for Prison Administration, and the Zurich Administrative Court, single judge.
Art. 32 Abs. 2 BGG; withdrawal of appeal and procedural discontinuance. Where an appeal is withdrawn, the Federal Supreme Court strikes the case from the docket without a merits decision. In such a discontinuation order, the Court may waive court costs; the proceeding is thereby terminated by order rather than by judgment on the substance.
