Résumé Omnilex

The Swiss Federal Supreme Court held that the criminal complaint against the Aargau cantonal appeal judgment was late. Because the appellant could not be found at home, a pickup notice was left in the mailbox and service was deemed completed at the end of the seven-day collection period. The court rejected any duty of the cantonal court to investigate a new address. The complaint filed on 26 January 2008 was therefore out of time, leading to non-entry under Article 108 BGG and a cost order against the appellant.

Regeste Omnilex

Art. 108 BGG; timeliness of a complaint after failed postal service and deemed service. Where service of an appellate judgment is attempted at the party’s known address and a pickup notice is deposited, service is deemed effected at the end of the collection period. It is the addressee’s duty, under the principle of good faith, to ensure that the authority can validly serve the decision; there is no duty on the appellate court to search ex officio for a new address. A complaint lodged after expiry of the time limit is inadmissible and may be disposed of by non-entry in summary procedure; costs are borne by the losing party (consid. 1-2).

Urteil vom 8. Februar 2008
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Aargau, Frey-Herosé-Strasse 12, Wielandhaus, 5001 Aarau,
Beschwerdegegnerin.

Gegenstand
Diebstahl, Hausfriedensbruch; Wiederherstellungsgesuch,

Beschwerde gegen das Urteil des Obergerichts des Kantons Aargau, Strafgericht, 2. Kammer, vom 25. Juli 2007.

Der Präsident zieht in Erwägung:

1.

3.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Aargau, Strafgericht, 2. Kammer, schriftlich mitgeteilt.

Question juridique clé

Whether the criminal complaint was filed within the statutory time limit after deemed service of the cantonal judgment

Solution extraite

The complaint was untimely because service was deemed completed on the last day of the pickup period, and the filing on 26 January 2008 was therefore late.

Motifs extraits

When the delivery attempt failed, a pickup notice was left in the mailbox. Under the fiction of service, the judgment was considered served on the last day of the seven-day pickup period. The appellant, not the court, had to ensure that the appellate decision could be served at the correct address; the court had no duty to search for a new address.

Question juridique clé

Whether the federal court should enter into the complaint under Article 108 BGG

Solution extraite

No entry was possible because the complaint was manifestly late.

Motifs extraits

Since the filing deadline had expired, the court could dispose of the matter in summary procedure under Article 108 BGG.

Question juridique clé

Who bears the court costs

Solution extraite

The appellant must bear the court costs.

Motifs extraits

As the complaint was not entered into, the costs were imposed on the appellant.
