In a criminal matter concerning a non-prosecution order for voies de fait, the appellant informed the Federal Supreme Court by letter that he wished to have the proceedings annulled. The President of the Criminal Law Division therefore ordered the case struck from the docket and waived judicial costs. The order was communicated to the parties and to the Vaud cantonal accusatory tribunal.
Withdrawal of the appeal or request to discontinue proceedings before the Federal Supreme Court; where the appellant declares that he wishes to have the proceedings annulled, the case is struck from the docket. In such a procedural situation, and absent circumstances justifying a different allocation, no judicial costs are charged (consid. 1).
