Résumé Omnilex

The Federal Supreme Court did not enter into the criminal complaint against the Zurich appellate non-entry decision concerning an alleged breach of bank secrecy. It held that the appellant failed to comply with the reasoning requirement under Art. 42(2) BGG, as he did not address the cantonal court’s key point on limitation. The request for free legal aid was denied because the appeal was hopeless. Court costs of CHF 500 were imposed, taking account of the appellant’s financial situation.

Regeste Omnilex

Art. 42 Abs. 2 BGG; Art. 108 BGG; insufficient reasoning of a federal complaint against a cantonal non-entry decision. A party contesting a non-entry ruling must specifically address the decisive reasoning of the lower court and show, by reference to federal law, why the ruling is unlawful; a mere assertion or unrelated remark does not satisfy the duty to state reasons. Where the submission does not confront the core ground, notably limitation, the Federal Supreme Court does not enter into the complaint under the simplified procedure. Free legal aid is refused if the appeal lacks prospects of success; costs may be reduced in view of the appellant’s financial situation (Art. 64, 65 Abs. 2, 66 Abs. 1 BGG).

Urteil vom 12. September 2013

Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
A.________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Zürich,
2. X.________ AG,
Beschwerdegegnerinnen.

Gegenstand
Einstellungsverfügung (Verletzung des Bankgeheimnisses),

Beschwerde gegen den Beschluss des Obergerichts des Kantons Zürich, III. Strafkammer, vom 28. Juni 2013.

Der Einzelrichter zieht in Erwägung:

1.

4.

Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, III. Strafkammer, schriftlich mitgeteilt.

Solution extraite

Legal aid was refused because the appeal lacked prospects of success.

Motifs extraits

The claims were hopeless, so the prerequisites of Art. 64 BGG were not met.

Question juridique clé

Allocation of court costs

Solution extraite

Court costs were imposed on the appellant, with reduced assessment in light of his financial situation.
