Résumé Omnilex

The Federal Supreme Court did not enter into a criminal complaint against a cantonal non-entry decision because the submission did not meet the reasoning requirements of Art. 42(2) BGG. Since the appellant did not engage with the cantonal court’s reasoning, the Court could not examine the merits. The request for free legal aid was refused because the appeal had no prospects of success, and court costs of CHF 500 were imposed on the appellant with regard to her financial situation.

Regeste Omnilex

Art. 42 Abs. 2 BGG; Art. 108 BGG: A federal complaint is inadmissible if it does not specifically address the reasoning of the challenged decision and does not show in what respect that decision allegedly violates federal law. Where the cantonal authority has not ruled on the merits, the Federal Supreme Court cannot examine the substantive issues in the first instance. Art. 64 BGG: free legal aid is refused when the appeal is hopeless. Art. 65 Abs. 2 and Art. 66 Abs. 1 BGG: costs are imposed on the unsuccessful party, but the amount may be adjusted to financial circumstances.

Urteil vom 30. September 2013

Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführerin,

gegen

Staatsanwaltschaft des Kantons Zug,
An der Aa 4, 6300 Zug,
Beschwerdegegnerin.

Gegenstand
Nichtanhandnahme, Einstellung (Beschimpfung, Missbrauch einer Fernmeldeanlage, Drohung),

Beschwerde gegen die Präsidialverfügung des Obergerichts des Kantons Zug, I. Beschwerdeabteilung, vom 13. August 2013.

Der Einzelrichter zieht min Erwägung:

1.
