Résumé Omnilex

The Federal Supreme Court did not enter into the complainant’s appeal against the cantonal order concerning the opening of an investigation against officials and civil servants. It held that he lacked standing as an informant/injured person and that the appeal was insufficiently reasoned; it also appeared otherwise inadmissible. The request for free legal aid was refused because the appeal was hopeless. Court costs of CHF 800 were imposed on the complainant, reduced in light of his financial circumstances. The request for suspensive effect became moot.

Regeste Omnilex

Art. 81 Abs. 1, Art. 42 Abs. 2 und 7, Art. 64, Art. 65 Abs. 2, Art. 66 Abs. 1, Art. 108 BGG; admissibility of a complaint by an informant/injured person and reasoning requirements. An informant or injured person lacks standing to appeal unless the statutory prerequisites of Art. 81 Abs. 1 BGG are met. The Federal Supreme Court examines compliance with the duty to reason ex officio only within the limits of the pleaded objections; a complaint that does not address the challenged decision in a legally sufficient manner is inadmissible. Legal aid is refused where the appeal is devoid of prospects of success. Costs may be reduced in view of the appellant’s financial circumstances.

Urteil vom 15. Januar 2008
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiberin Arquint Hill.

Parteien
X.________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Florhofgasse 2, 8001 Zürich,
Beschwerdegegnerin.

Gegenstand
Eröffnung einer Untersuchung gegen Behördenmitglieder und Beamte,

Beschwerde gegen den Beschluss des Obergerichts des Kantons Zürich, II. Zivilkammer, vom 22. Oktober 2007.

Der Präsident zieht in Erwägung:
1.

4.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, II. Zivilkammer, schriftlich mitgeteilt.
