Résumé Omnilex

The Federal Supreme Court did not enter into a criminal complaint against a cantonal non-entry decision concerning alleged defamation and murder complaints. It held that the appellant's filing was partly abusive and failed to meet the Federal Supreme Court's reasoning requirements. The issue of standing could remain open. Court costs of CHF 800 were charged to the appellant.

Regeste Omnilex

Art. 42 Abs. 2, Art. 106 Abs. 2 and Art. 108 BGG; non-entry for insufficiently reasoned complaint: A Federal Supreme Court complaint is inadmissible where the submission does not, in a concrete and reasoned manner, engage with the decisive considerations of the cantonal judgment and does not demonstrate with sufficient clarity any violation of law or constitutional rights. Purely appellatory or abusive arguments do not satisfy the federal pleading requirements. The question of standing may be left open if the complaint is manifestly insufficiently reasoned. In such a case, the court may decide without further exchange of written submissions and impose costs on the unsuccessful party under Art. 66 Abs. 1 BGG.

Urteil vom 5. Januar 2009
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Solothurn, Franziskanerhof, Barfüssergasse 28, 4502 Solothurn,
Beschwerdegegnerin.

Gegenstand

Question juridique clé

Whether the complaint met the Federal Supreme Court's reasoning requirements and could be heard under summary non-entry procedure.

Solution extraite

The filing did not show, in a sufficiently reasoned manner, any obvious erroneous findings of fact or violations of constitutional or federal law; the court therefore could not enter into the complaint.

Motifs extraits

The submission was partly abusive and failed to satisfy Art. 42(2) and Art. 106(2) BGG; therefore non-entry under Art. 108 BGG was appropriate. The question of standing could be left open.

Question juridique clé

Who bears the court costs of the federal proceedings?

Solution extraite

The costs were imposed on the appellant.

Motifs extraits

As the complaint was not entered into, the appellant had to bear the court fees under Art. 66(1) BGG.
