Résumé Omnilex

The appellant challenged a cantonal appellate judgment that had granted him CHF 7,335.65 in damages after a discontinued criminal investigation but rejected the rest of his claim. Before the Federal Supreme Court, he maintained the full damage claim, yet his filing merely repeated accusations against the prosecutor and his own account of events. The Court held that he failed to meet the federal reasoning requirement and therefore refused to enter into the appeal under the summary procedure. Free legal aid was denied because the appeal was hopeless, and costs of CHF 500 were imposed on the appellant.

Regeste Omnilex

Art. 42 Abs. 2 BGG, Art. 108 BGG; requirements of reasoning for a federal appeal and non-entry in summary procedure. A party must, by reference to the challenged decision, set out specifically in what respect it is alleged to violate federal law. Mere criticism, unsupported allegations, or a presentation of one’s own view of the facts is insufficient. If the appeal manifestly fails to satisfy the reasoning requirement, the Federal Supreme Court may decline to hear it under Art. 108 BGG. A request for legal aid under Art. 64 BGG must be refused where the appeal is devoid of prospects of success; court costs are then allocated under Art. 66 Abs. 1 BGG, with due regard to the party’s financial situation under Art. 65 Abs. 2 BGG.

Urteil vom 21. Oktober 2013

Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Generalstaatsanwaltschaft des Kantons Thurgau, Zürcherstrasse 323, 8510 Frauenfeld,
Beschwerdegegnerin.

Gegenstand
Schadenersatz,
