Résumé Omnilex

X. applied for revision of a prior Federal Supreme Court decision in criminal proceedings after his earlier complaint had been declared inadmissible for lack of sufficient reasoning. The Criminal Division held that revision is only available on the grounds listed in Arts. 121-123 BGG, and that the applicant's filing consisted merely of irrelevant arguments and general criticism. The court therefore declined to enter into the revision request and charged the applicant with CHF 1,000 in court costs.

Regeste Omnilex

Arts. 121-123 BGG; revision of a Federal Supreme Court judgment requires a clearly substantiated statutory ground. Mere general criticism of the prior judgment or arguments unrelated to a revision ground are inadmissible and do not justify entry into the application. Where the request fails to invoke and substantiate a cognizable ground, the court will not enter into it; costs are borne by the unsuccessful applicant under Art. 66 Abs. 1 BGG.

Urteil vom 15. Juli 2009
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Bundesrichter Ferrari, Mathys,
Gerichtsschreiberin Arquint Hill.

Parteien
X.________,
Gesuchsteller,

gegen

Statthalteramt Arlesheim, 4144 Arlesheim,
Gesuchsgegner.

Gegenstand
Revisionsgesuch gegen das Urteil 6B_366/2009
des Schweizerischen Bundesgerichts vom
18. Mai 2009.

Das Bundesgericht zieht in Erwägung:

1.

Lausanne, 15. Juli 2009

Question juridique clé

Who bears the court costs of the revision proceedings?

Solution extraite

The applicant must bear the court costs.

Motifs extraits

Under Art. 66(1) BGG, costs are charged to the unsuccessful party.
