Résumé Omnilex

The applicant requested revision of a prior Federal Supreme Court judgment. The court held that a revision request must invoke and substantiate one of the statutory grounds under Arts. 121-123 BGG. Because the applicant merely criticized the earlier legal reasoning and repeated arguments from the complaint proceedings without identifying any revision ground, the court did not enter into the request. Court costs of CHF 1,000 were imposed on the applicant. The court also indicated that any further submissions in the matter, especially further revision requests, would in future be filed without formal processing.

Regeste Omnilex

Art. 121-123 BGG, Art. 42 Abs. 2 BGG; requirements for a revision request to the Federal Supreme Court. A request for revision of a Federal Supreme Court judgment is admissible only if it expressly invokes a statutory ground for revision and explains in a reasoned manner how the challenged judgment is said to satisfy that ground. Mere criticism of the prior reasoning or repetition of arguments already raised in the ordinary appeal proceedings does not meet the substantiation requirement. Where no revision ground is identified, the court will not enter into the request; costs are allocated to the unsuccessful applicant under Art. 66 Abs. 1 BGG.

Gesuchsgegner.

Gegenstand
Revision des Urteils des Bundesgerichts vom 5. März 2008 (6B_121/2008).

Das Bundesgericht zieht in Erwägung:

1.

Question juridique clé

Whether the revision request stated a recognized ground for revising a Federal Supreme Court judgment.

Solution extraite

The request did not identify any revision ground under Arts. 121-123 BGG and merely repeated criticism of the prior judgment; the court therefore could not enter into the request.

Motifs extraits

A revision application must specify which statutory ground is invoked and how the challenged judgment is said to establish it. Pure reconsideration of the legal reasoning and repetition of prior complaints is insufficient.

Question juridique clé

Allocation of court costs for the inadmissible revision request.

Solution extraite

Court costs were imposed on the applicant.

Motifs extraits

As the request was not entertained, the applicant had to bear the costs under Art. 66(1) BGG.
