Résumé Omnilex

A claimant appealed a Ticino insurance-court judgment to the Federal Supreme Court. The court held that the judgment was deemed served on 2014-05-09 because it arrived at the post office on 2014-05-02 and the seven-day service fiction of Art. 44(2) LTF applied. The 30-day appeal period therefore expired on 2014-06-10, while the appeal was filed only on 2014-06-13. The appellant did not invoke any grounds for restoration of the deadline. Applying the simplified procedure, the court declared the appeal inadmissible and waived court costs.

Regeste Omnilex

Art. 44 cpv. 2, 50, 100 cpv. 1 and 108 LTF; lateness of appeal and postal service fiction: service is deemed effected at the latest seven days after the first unsuccessful delivery attempt, independently of the postal retention period. This presumption also applies where the addressee has requested postal holding of mail, especially when judicial correspondence was foreseeable; the seven-day period runs from arrival of the item at the post office (consid. 1). Where the appeal deadline has expired and no grounds for restitution of time are shown, the appeal is manifestly inadmissible and may be dealt with under the simplified procedure of Art. 108 LTF; in such circumstances court costs may be waived pursuant to Art. 66 cpv. 1, second sentence, LTF.

Oggetto

108 cpv. 1 lett. a e cpv.
