The Federal Supreme Court dealt with an appeal in an invalidity insurance matter against a decision of the Zurich Social Insurance Court. The appellant had been refused legal aid for lack of prospects and was then ordered to pay an advance on costs by an extended deadline. He failed to do so. The single judge therefore held that the appeal could not be entered into in simplified procedure. Court costs of CHF 300 were imposed on the appellant.
Art. 62 Abs. 3 BGG; Art. 108 Abs. 1 lit. a and Abs. 2 BGG; non-payment of an ordered advance on costs after expiry of the grace period results in non-entry on the appeal in simplified procedure. The court examines only whether the procedural prerequisite of payment was complied with; if the advance remains unpaid, the remedy is inadmissible without examination of the merits. Pursuant to Art. 66 Abs. 1 and 3 BGG, the unsuccessful appellant bears the court costs.

in die Zwischenverfügung vom 17. März 2008, mit welcher das Gesuch um unentgeltliche Prozessführung wegen Aussichtslosigkeit der Beschwerde abgewiesen worden war,
in die Verfügung vom 23. April 2008, mit welcher H.________ zur Bezahlung eines Kostenvorschusses innert einer Nachfrist bis zum 5. Mai 2008 verpflichtet wurde, ansonsten auf das Rechtsmittel nicht eingetreten werde,
in Erwägung,
dass der Beschwerdeführer den ihm auferlegten Kostenvorschuss auch innerhalb der mit Verfügung vom 23. April 2008 angesetzten Nachfrist nicht geleistet hat,
dass deshalb gestützt auf Art. 62 Abs. 3 BGG im vereinfachten Verfahren nach Art. 108 Abs. 1 lit. a und Abs. 2 BGG auf die Beschwerde nicht einzutreten ist und der Beschwerdeführer nach Art. 66 Abs. 1 und 3 BGG kostenpflichtig wird,
erkennt die Einzelrichterin:

Auf die Beschwerde wird nicht eingetreten.
2.
Die Gerichtskosten von Fr. 300.- werden dem Beschwerdeführer auferlegt.
3.
Dieses Urteil wird den Parteien, dem Sozialversicherungsgericht des Kantons Zürich und dem Bundesamt für Sozialversicherungen schriftlich mitgeteilt.

Whether the appeal could be entered into despite non-payment of the ordered advance costs.
No. Because the appellant did not pay the advance costs even within the extended deadline, the court had to refuse entry on the appeal in simplified procedure.
Under Art. 62(3) BGG, failure to pay the ordered advance within the set grace period leads to non-entry; the conditions for summary non-entry under Art. 108(1)(a) and (2) BGG were met.
Allocation of court costs.
Court costs of CHF 300 were imposed on the appellant.
As the unsuccessful party in the non-entry decision, the appellant bears the costs under Art. 66(1) and (3) BGG.
