Résumé Omnilex

The Federal Supreme Court declared the complaint inadmissible because it did not satisfy the statutory minimum reasoning requirements. The appellant failed to engage with the cantonal court’s decisive considerations and did not show any legally relevant error in the factual findings or reasoning. The court therefore did not enter on the complaint under Art. 108 Abs. 1 lit. b BGG. In view of the circumstances, it waived court costs, which rendered the request for free legal assistance moot.

Regeste Omnilex

Art. 42 Abs. 1 and 2 BGG; Art. 108 Abs. 1 lit. b BGG; admissibility of a complaint and consequences of insufficient reasoning. A federal complaint must contain specific requests and, in concise form, a substantiated explanation showing how the challenged decision violates the law; the submissions must address the decisive reasons of the lower court. Mere criticism or unsupported assertions are insufficient. If the appellant fails to deal with the determinative considerations and does not plausibly challenge the factual findings or legal assessment, the remedy is manifestly inadmissible and no entry is made under Art. 108 Abs. 1 lit. b BGG. Where the circumstances justify waiving court costs, a pending request for legal aid becomes moot (consid. 1-3).

Urteil vom 16. Januar 2009
I. sozialrechtliche Abteilung

Besetzung
Bundesrichter Ursprung, Präsident,
Gerichtsschreiber Batz.

Parteien
A.________,
Beschwerdeführer,

gegen

Schweizerische Unfallversicherungsanstalt (SUVA), Fluhmattstrasse 1, 6004 Luzern,
Beschwerdegegnerin.

Gegenstand
Unfallversicherung,

in Erwägung,

Question juridique clé

Whether the complaint met the minimum reasoning requirements under the Federal Supreme Court Act.

Solution extraite

No. The filing did not sufficiently address the decisive reasons of the cantonal judgment and did not show in a cognizable way why the factual findings or legal reasoning were wrong.

Motifs extraits

A legal remedy must contain requests and reasoning showing, in a concise form, how the challenged decision violates the law. Because the appellant failed to engage with the decisive considerations, no valid remedy was filed.

Question juridique clé

Whether the Federal Supreme Court should waive court costs and what follows for the legal-aid request.

Solution extraite

Court costs were waived in view of the circumstances, and the legal-aid request became moot.

Motifs extraits

Since no costs were charged, there was no remaining need to decide the request for free legal assistance.
