Résumé Omnilex

The Federal Supreme Court dismissed the appeal in a summary non-entry decision because the appellant's filing did not satisfy the reasoning requirements of Art. 42 BGG. The submission failed to show, even in outline, how the cantonal decision violated federal law or relied on manifestly incorrect fact-finding. Given the deficient reasoning and prior warnings, the court refused to enter into the merits and charged the appellant CHF 200 in costs.

Regeste Omnilex

Art. 42 Abs. 1 und 2 BGG; Art. 95 f. BGG; Art. 97 Abs. 1 BGG; Art. 108 Abs. 1 lit. b BGG; insufficient reasoning of the appeal as a ground of non-entry. An appeal must contain prayers for relief and a concise statement of reasons showing in what respect the challenged decision violates federal law; where factual findings are attacked, the complaint must specifically indicate manifest inaccuracy or legal error in the sense of Art. 97 Abs. 1 BGG. A submission failing to meet these minimum requirements is not a valid remedy. In such a case, the Federal Supreme Court may decline to enter in simplified proceedings. Costs are borne by the unsuccessful appellant pursuant to Art. 66 Abs. 1 and 3 BGG.

Oktober 2012.

Nach Einsicht
in die Beschwerde des I.________ vom 15. November 2012 (Poststempel) gegen den Entscheid des Verwaltungsgerichts des Kantons Bern, Sozialversicherungsrechtliche Abteilung, vom 18. Oktober 2012 (Verfahren 200 12 355 ALV),

in Erwägung,

Question juridique clé

Whether the federal appeal met the minimum reasoning requirements under Art. 42 BGG.

Solution extraite

No; the submission did not sufficiently explain in what respect the cantonal judgment violated law or contained manifestly incorrect fact-finding.

Motifs extraits

The court held that the appeal lacked any adequate legal reasoning and therefore did not satisfy the formal requirements of a valid remedy, despite prior warnings to the appellant.

Question juridique clé

Whether the appeal should be examined in simplified proceedings.

Solution extraite

Yes; because the appeal was manifestly non-compliant, the court declined to enter on it under the simplified procedure.

Motifs extraits

The absence of a validly reasoned remedy justified non-entry without a full merits examination.

Question juridique clé

Allocation of court costs.

Solution extraite

The appellant had to bear the court costs of CHF 200.

Motifs extraits

As the appeal was not entered into, costs were imposed on the appellant under the Federal Supreme Court Act.
