Résumé Omnilex

The Federal Supreme Court dismissed the insured person's appeal against the Zurich Social Insurance Court judgment upholding the abolition of her full disability pension as of end-April 2010. It held that the objections to the mixed method of disability assessment were unfounded, that a status change alone can justify revision, and that no breach of the duty to investigate or right to be heard was shown. The court also found no arbitrariness in the evaluation of medical evidence and rejected the constitutional and ECHR complaints as insufficiently substantiated. Court costs of CHF 500 were charged to the appellant.

Regeste Omnilex

Art. 17 Abs. 1 ATSG; Art. 28a Abs. 3 IVG; Art. 43 Abs. 1 und Art. 61 lit. c ATSG; Art. 106 Abs. 2 BGG: Revision of disability pension following status change and review of evidentiary assessment. A change in status may in itself constitute a revision ground. In applying the mixed method, the decisive question is whether the factual findings as to work and household activity are supportable; objections not timely raised in the administrative or cantonal proceedings need not be examined. The court intervenes in evidence assessment only if the lower court disregarded relevant evidence or acted arbitrarily. Internal expert working notes need not be disclosed if they are merely internal documents. Constitutional and Convention complaints require specific substantiation (consid. 1-5).

Beschwerdegegnerin.

Gegenstand
Invalidenversicherung,

August 2011.

In Erwägung,
Versicherungsgerichts I 502/97 vom 8.
März 2010 eingetreten sind (u.a. Aufenthalt Klinik X.________ vom 8. bis 30. April 2010, Ereignis vom 18. Dezember 2010, psychiatrisches Gutachten vom 17. Januar 2011, Fremdplatzierung der Tochter gemäss Beschluss der Vormundschaftsbehörde vom 18. April 2011),

Question juridique clé

Whether the mixed method of disability assessment was correctly applied for a 50% employment share.

Solution extraite

The complaint failed; the challenge to the mixed method had no merit.

Motifs extraits

The arguments against applying the mixed method under Art. 28a(3) IVG were unconvincing, and no earlier procedural objection had been raised against the household investigator's account.

Question juridique clé

Whether the status change alone constituted a ground for revision of the disability pension.

Solution extraite

Yes. A change in status by itself can constitute a revision ground.

Motifs extraits

The court relied on established case law that a status change alone is sufficient under Art. 17(1) ATSG.

Question juridique clé

Whether the authorities breached the duty to investigate the relevant facts up to the time of the pension decision.

Solution extraite

No such violation was shown.

Motifs extraits

No breach of Art. 43(1) and Art. 61(c) ATSG could be attributed to the IV office or the lower court with respect to facts relevant up to the date of the decision.

Question juridique clé

Whether the lower court's assessment of evidence was arbitrary or violated free evaluation of evidence.

Solution extraite

No. The lower court did not act arbitrarily or violate the principle of free assessment of evidence.

Motifs extraits

The court accepted that the treating psychiatrist's differing view did not significantly undermine the probative value of the administrative expert report of 29 December 2008.

Question juridique clé

Whether the non-disclosure of the expert's handwritten notes violated the right to be heard.

Solution extraite

No. The failure to release the notes did not amount to a hearing violation.

Motifs extraits

The notes were treated as internal working materials excluded from access rights.

Question juridique clé

Whether the qualifications of the doctors of the Psychiatry Center X.________ needed review.

Solution extraite

No serious reasons were given to require such review.

Motifs extraits

The appellant did not provide serious grounds casting doubt on the experts' professional qualifications.

Question juridique clé

Whether the alleged ECHR and constitutional violations were sufficiently substantiated.

Solution extraite

No. The constitutional and Convention complaints were not adequately reasoned.

Motifs extraits

The submissions did not meet the substantiation requirement of Art. 106(2) BGG.
