Résumé Omnilex

The Federal Supreme Court held that the appellant's filing in an invalidity insurance case did not satisfy the statutory reasoning requirements for a federal appeal. Although he requested a medical examination due to poor health, he failed to show that the cantonal court's findings of fact were erroneous or that its legal reasoning was flawed. The Court therefore declined to enter on the appeal in simplified procedure, without granting a remedy period, and waived court costs.

Regeste Omnilex

Art. 42 Abs. 1 and 2 BGG; Art. 97 Abs. 1 BGG; Art. 108 Abs. 1 lit. b and Abs. 2 BGG: the appeal must set out, in concise form, how the challenged decision infringes law and, where factual findings are attacked, why they are manifestly incorrect or legally irrelevant. A mere request for taking evidence or a general reference to health problems does not satisfy the substantiation duty. Where the deficiency is obvious, the Federal Supreme Court may decline entry in simplified procedure without granting a time limit to cure; costs may exceptionally be waived under Art. 66 Abs. 1 sentence 2 BGG (consid. 1).

Urteil vom 6. Dezember 2013

II. sozialrechtliche Abteilung

Besetzung
Bundesrichter Meyer, als Einzelrichter,
Gerichtsschreiber Fessler.

Verfahrensbeteiligte
D.________,
Beschwerdeführer,

gegen

IV-Stelle des Kantons Zürich,
Röntgenstrasse 17, 8005 Zürich,
Beschwerdegegnerin.

Gegenstand
Invalidenversicherung,

September 2013,

in Erwägung,

Question juridique clé

Whether the appeal met the minimum reasoning requirements under the Federal Supreme Court Act.

Solution extraite

No. The appeal did not explain why the lower court's factual findings were incorrect or why its reasoning was legally flawed.

Motifs extraits

A valid appeal must contain requests and reasons; mere reference to poor health and a request for medical evidence is insufficient without showing how the challenged findings violate federal law.

Question juridique clé

Whether a grace period to remedy the defective appeal should be granted.

Solution extraite

No. In simplified procedure the court may refuse entry without setting a cure period.

Motifs extraits

Because the lack of reasoning was manifest, the court applied the summary non-entry procedure without allowing rectification.

Question juridique clé

Whether court costs should be charged.

Solution extraite

No court costs were imposed as an act of leniency.

Motifs extraits

The court waived costs under the statutory exception for the circumstances of the case.
