Résumé Omnilex

W. filed a federal appeal against a cantonal non-entry decision in an invalidity insurance case. The Federal Court held that the appeal did not comply with Art. 42 BGG because it failed to explain why the cantonal court should have entered the case and instead addressed only the merits. In the simplified procedure the court therefore declined to enter the appeal. Considering the circumstances, it waived court costs and consequently did not require an advance on costs. The decision was communicated to the parties, the cantonal social insurance court, the Basel-Landschaft compensation office, and the Federal Office for Social Insurance.

Regeste Omnilex

Art. 42 Abs. 1 und 2 BGG; Art. 108 Abs. 1 lit. b BGG; non-entry decisions are inadmissibly challenged when the appeal does not address the refusal to enter but only the substantive merits. An appeal must, in condensed form, show in what respect the contested act violates law; a mere repetition of the material arguments is insufficient. In proceedings concerning a cantonal non-entry decision, the appellant must specifically plead why the lower court was obliged to enter into the matter (cf. consid. 2). Where the appeal manifestly lacks such reasoning, the Federal Court may decline to enter in simplified procedure. If the circumstances justify it, court costs may be waived under Art. 66 Abs. 1 BGG, which makes a prior cost-advance order unnecessary (consid. 3).

Urteil vom 31. Januar 2008
II. sozialrechtliche Abteilung

Besetzung
Bundesrichter U. Meyer, Präsident,
Gerichtsschreiber Traub.

Parteien
W.________, Beschwerdeführer,

gegen

IV-Stelle Basel-Landschaft, Hauptstrasse 109, 4102 Binningen, Beschwerdegegnerin.

Gegenstand
Invalidenversicherung,

in Erwägung,

Question juridique clé

Whether the federal appeal met the formal requirements of Art. 42 BGG after a non-entry decision below.

Solution extraite

The appeal did not contain a sufficient challenge to the cantonal non-entry decision, because it dealt only with the merits of the case and not with why the lower court should have entered the appeal.

Motifs extraits

Under Art. 42(1)-(2) BGG, an appeal must state the relief sought and briefly explain how the contested decision violates the law. In non-entry matters, arguments addressing only the substantive merits are not a proper appeal reasoning.

Question juridique clé

Whether court costs should be charged and a deadline set for the cost advance.

Solution extraite

No court costs were imposed, and therefore no deadline for paying an advance was set.

Motifs extraits

Given the circumstances, the court exercised its discretion to waive costs under Art. 66(1) BGG; as a result, the advance-payment mechanism under Art. 62(3) BGG was unnecessary.
