The Federal Administrative Court considered an appeal against the BFM’s asylum and removal decision of 21 May 2010 together with a request to restore the expired appeal deadline. It rejected the restoration request, held that the appeal could therefore not be entered, lifted the provisional stay of removal, and ordered court costs of CHF 300 against the appellant. The appellant was represented by BUCOFRAS.
Restoration of an expired appeal deadline in asylum matters; the applicant must show sufficient grounds for non-compliance with the time limit. If restoration is refused, the appeal is time-barred and the court does not enter into the merits; any provisional suspension of removal falls away accordingly (cf. consid. 1-3). Court costs may be imposed on the unsuccessful appellant.
