The court held that a directive on reduced tax exemption for subsidized property owners must be interpreted consistently with equal treatment. Where German-domiciled owners pay no German tax on the properties, Swiss tax cannot be credited abroad; they are then in the same position as Swiss taxpayers. Refusing to pass on the tax-exemption reduction to rents would therefore be discriminatory. The matter was sent back to the OCL to calculate the amount that could have been charged to rental statements and to require retroactive pass-through to the relevant tenants.

La directive du CE du 28.01.1981 prévoyant que la dégrenivité de l'exonération fiscale, laquelle est accordée aux propriétaires d'immeubles subventionnés, n'est pas répercutée sur les loyers si la législation en vigueur les autorise à imputer la charge fiscale suisse sur les impôts à payer dans leur pays, doit être interprêtée de façon à respecter le principe de l'égalité de traitement. En conséquence, si, comme en l'espèce, les propriétaires d'immeubles subventionnés, domiciliés en Allemagne, ne paient aucun impôt allemand sur leurs immeubles, l'imputation des impôts suisses n'est pas possible et le refus de reporter toute diminution de l'exonération fiscale viole le principe de l'égalité de traitement, car leur situation ne diffère pas de celle d'un contribuable suisse. En l'espèce, la cause a été renvoyée à l'OCL pour qu'il examine le montant qui aurait pu, à l'époque, être reporté sur les états locatifs, à charge pour les propriétaires de reporter rétroactivement ce montant sur les loyers des locataires qui ont été avertis par l'OCL de la procédure de réclamation.
