Les statuts du personnel de l'administration de la Ville de Genève prévoient que le Conseil administratif peut librement résilier l'engagement d'un fonctionnaire à l'essai. Le Tribunal administratif doit donc faire preuve d'une extrême réserve quant au contrôle de l'excès du pouvoir d'appréciation, mais conserve un plein pouvoir d'examen quant à la validité formelle du licenciement.
