The appellant challenged the refusal of a housing allowance. Faute de preuve, les agissements (allégués) de l'ex-mari de la recourante à l'égard de celle-ci (notamment le fait de la suivre jusqu'à son domicile) ne constituent pas un inconvénient majeur au sens de l'art. 39A LGL. En revanche, on ne saurait exiger que la fille de la recourante, âgée de 24 ans, vive dans une chambrette de 7,69 m2. En effet, chacun a droit à un logement décent (droit qui découle de l'art. 10A CST. gen.). En conséquence, la recourante a droit, pour son nouveau logement plus vaste, à une allocation de logement. L'art. 10 A Cst. gen. ne permet pas de se prévaloir en justice du droit d'obtenir un logement, mais confère cependant le droit à un logement décent. Ainsi, la recourante qui a quitté un logement dans lequel sa fille de 24 ans occupait une pièce de 7,7 m2 et a emménagé dans un logement plus grand a droit à une allocation de logement.
