A TPG employee contested a disciplinary warning before the Geneva Tribunal administratif. The court held that TPG employees are not civil servants, so the LPAC does not apply and cannot establish disciplinary jurisdiction. Jurisdiction also could not be derived from Article 1 of the transitional implementing regulation of the LTA. The appeal was therefore dismissed for lack of competence.

LTA art. 8; competence of the administrative court in disciplinary matters concerning TPG employees: employees of Transports publics genevois are not civil servants and are therefore not subject to the LPAC disciplinary regime. The administrative court lacks jurisdiction to hear an appeal against a disciplinary warning issued to such an employee. Such jurisdiction cannot be inferred either from the transitional implementing regulation of the LTA. Distinction is drawn between disciplinary sanctions and pecuniary claims, the latter falling within administrative jurisdiction where the statutory conditions are met.

Les employés des TPG n'étant pas des fonctionnaires, la LPAC ne leur est pas applicable et ne saurait fonder la compétence du Tribunal administratif en matière disciplinaire. Il en va différemment des actions pécuniaires. Cette compétence ne saurait davantage résulter de l'art. 1 du règlement transitoire d'application de la LTA. Le TA n'est pas compétent pour connaître d'un recours dirigé contre un avertissement infligé à un employé des Transports publics genevois
