Résumé Omnilex

The recourants sought a change of social housing, arguing that their apartment was unsuitable. The court held that the former flat still had a sufficient number of rooms for the family, including after the birth of a child during the proceedings. The fact that the elevator was too small for a stroller and that one family member slept in a room originally intended as a dining room did not amount to a grave inconvenience under LGL 39A(1). The appeal was therefore dismissed.

Regeste Omnilex

LGL 39A al. 1; change of social housing requires a grave inconvenience of sufficient intensity. The assessment is primarily based on the objective suitability of the apartment, in particular the number of rooms in relation to the family size. Minor practical disadvantages, such as a lift too small for a stroller or the use of a room originally designated as a dining room for sleeping, do not meet the statutory threshold. A later increase in family size during the proceedings does not automatically establish the required hardship if the accommodation remains objectively adequate.

Question juridique clé

Whether the appellants had a grave inconvenience justifying a change of social housing apartment under LGL 39A(1).

Solution extraite

No. The former apartment had enough rooms for the whole family, even after the birth of a child during the proceedings; a too-small elevator for a stroller and sleeping in a room that had originally been a dining room were not serious inconveniences.

Motifs extraits

The court assessed the family’s housing situation by the number of rooms and found no major hardship reaching the statutory threshold.
