Art. 130 al. 1 OLAA; opposition proceedings and formal admissibility requirements: where an opposition remains unmotivated despite repeated, duly granted time limits, the authority may, after a substantial lapse of time, issue a non-entry decision for formal defect. Persistent failure to cure the defect does not constitute excessive formalism when the authority has allowed several opportunities to remedy the omission. A vexatious litigant sanction may be imposed when the appellant persists in challenging the non-entry decision without curing the decisive procedural irregularity.

La CNA n'a fait que respecter les exigences légales en accordant au conseil du recourant six délais successifs pour motiver son opposition, puis en rendant, 11 mois après le dépôt de la déclaration d'opposition, une décision de non-entrée en matière sur le fond, tirée de l'irrégularité formelle de l'opposition. Le fait pour l'assuré de n'avoir pas motivé son opposition à une décision d'une caisse-maladie, tout en ayant requis à 8 reprises un délai pour ce faire, permet à la caisse, 11 mois après le dépôt de la déclaration d'opposition, de rendre une décision de non entrée en matière sur le fond, tirée de l'irrégularité formelle de l'opposition. L'assuré qui recourt contre cette décision se voit infliger une amende pour téméraire plaideur de CHF 500.--.
