Résumé

L'agrandissement d'un hôtel quatre étoiles peut être souhaitable et compatible avec les conditions de vie du quartier de Plainpalais, vu son utilité sur le plan de l'accueil des visiteurs et des activités économiques (art. 8 al. 1 parag. 1 LDTR). En revanche, si l'immeuble à transformer ne revêt pas un caractère de précarité qui rendrait aléatoires les conditions d'habitation, condition cumulative nécessaire à l'octroi d'une dérogation (art. 8 al. 1 parag. 2 LDTR), un tel agrandissement ne peut être autorisé. La prise de participations financières compensatoires dans la construction d'un immeuble de logements HLM n'est pas admissible au regard de l'art. 8 LDTR, ce dernier n'autorisant que les compensations en nature par réaffectation simultanée de surfaces commerciales ou administratives.
