An insured person challenged a health insurer’s refusal to reimburse the full costs of a hospital stay. The court held that the insurer could not rely solely on a discharge letter and a conversation with the hospital’s assistant physician to conclude that the treatment and examinations could have been done on an outpatient basis. The insurer had to have the insured medically examined and had to substantiate specifically why outpatient care would have been sufficient. The denial of coverage was therefore unjustified.

Résumé

Refus injustifié de la part d'une caisse-maladie de prendre en charge l'intégralité d'un séjour hospitalier. Le médecin-conseil de la caisse ne saurait considérer que la patiente aurait pu suivre les traitements et subir les examens médicaux de manière ambulatoire sur la seule base d'une lettre de sortie et d'un entretien avec le médecin-assistant du service ayant accueilli l'assurée. La caisse se devait de faire examiner son assurée et de motiver en quoi ces traitements et examens auraient pu se faire de manière ambulatoire.
