The case concerns a building project in which a definitive permit differed only slightly from a preliminary permit, by adding garages and swimming pools. The court held that these changes did not destroy the identity of the project between the two authorizations. It also held that norms contained in quartier regulations annexed to an aménagement plan are not zoning plans when they were not subjected to public inquiry. Finally, a communal development plan and quartier regulation from 1938 that were never published cannot be treated as binding zoning plans.

Résumé

Une légère modification dans l'autorisation définitive de l'implantation des villas, l'adjonction de garages et de piscines par rapport à l'autorisation préalable, ne modifient pas l'identité entre l'objet des 2 autorisations. Les normes figurant dans des règlements de quartiers annexés aux plans d'aménagement ne sont pas des plans d'affectation, car ils ne sont pas soumis à enquête publique. Un plan d'aménagement communal et son règlement de quartier datant de 1938 et n'ayant jamais été publiés ne peuvent être qualifiés de plans d'affectation dotés de force obligatoire.
