A garage car with a U plate was involved in a speed offense. SAN tried to notify the sanction to one of the garage’s managing partners, but the record did not establish, or even make it probable, that he was the driver. The court held that this was insufficient to attribute the offense to him and therefore annulled the sanction insofar as it was directed to that person.

LCR art. 17 al. 1; identification of the offender in a traffic offense involving a garage vehicle: a sanction may not be addressed to a managing partner merely because of his position within the garage. The authority must establish, at least as probable, that the person concerned actually committed the offense. Absent such factual linkage, notification of the sanction to that person is impermissible (consid. 1).
