A tenant suffering from allergies to mites and grasses sought authorization to move from a studio to a larger and more expensive apartment so that she could install a proper bed and other furnishings needed for her condition. The court held that Art. 39a LGL, which does not force a tenant to accept a cheaper exchange when it creates a major inconvenience, likewise does not require the tenant to remain in the former flat when staying would cause the same problem. The inability to use necessary furniture for allergy management constituted a major inconvenience, so the move was justified.

"Si l'art. 39 LGL ne permet pas d'exiger d'un locataire qu'il procède à un échange avec un logement moins onéreux si cela lui cause un inconvénient majeur, de même cette disposition ne permet-elle pas non plus d'exiger d'un locataire qu'il reste dans son ancien logement moins cher si cela lui cause un tel inconvénient. Le fait de ne pouvoir disposer du mobilier nécessaire à lutter contre des affections allergiques (en l'espèce l'installation d'un vrai lit) constitue, contrairement à ce qu'allègue l'OLS, un inconvénient grave, qui autorisait la recourante à changer de logement pour pouvoir disposer d'une pièce supplémentaire". Doit être considéré comme un inconvénient majeur (art. 39A LGL) justifiant la prise d'un logement plus grand et plus coûteux, le fait de souffrir d'une allergie aux acariens et aux graminées et de ne pas pouvoir installer, dans un studio, un lit exigé par cette affection.
