Résumé Omnilex

The case concerns a debtor who, after being in lasting insolvency, repaid CHF 3,600 in maintenance and offered to pay another CHF 1,800 the following month. The court held that these circumstances are enough to justify reconsidering whether lasting insolvency still exists. At the same time, it confirmed that SCARPA may primarily apply the amounts received to reimbursement of the state advance rather than to the children’s current maintenance. The appeal was therefore only partially successful.

Regeste Omnilex

Art. 10 al. 3 LARPA; lasting insolvency and allocation of payments by SCARPA: where a maintenance debtor makes concrete repayments and gives a credible undertaking to pay further sums, the factual basis for continuing to qualify the debtor as durably insolvent falls away and a reassessment request is justified. However, the service may, in the first instance, allocate the sums received to reimbursement of the advance granted by the State, before any allocation to the children's maintenance. The two questions—insolvency status and allocation of recovered amounts—must be distinguished (consid. unspecified).

Question juridique clé

Whether a debtor who has repaid maintenance amounts and offered further payment can still be regarded as durably insolvent under Art. 10(3) LARPA.

Solution extraite

The debtor can no longer be treated as durably insolvent; the repayment and promised further payment are sufficient indications for a reconsideration request.

Motifs extraits

The recent repayments and the concrete promise of an additional payment show a changed financial situation inconsistent with a continuing state of lasting insolvency.

Question juridique clé

Whether SCARPA may apply the received amounts first to reimbursement of the state advance rather than to current child maintenance.

Solution extraite

Yes. SCARPA is entitled to allocate the payments primarily to repayment of the state advance.

Motifs extraits

Art. 10(3) LARPA allows the service to direct the funds to the recovery of advances granted by the State before earmarking them for the children's maintenance.
