In a dispute concerning complementary daily indemnity insurance, the court held that the standards for assessing a medical adviser’s report are the same as in social insurance. Where the report is complete in light of the contested rights, based on thorough examinations, takes account of the insured’s complaints, is prepared with knowledge of the patient’s history, and presents a coherent medical picture, the judge need not order further evidence even under the duty to investigate ex officio.

"S'agissant de l'activité du médecin mandaté comme expert par un assureur lié à un employeur par un contrat prévoyant des indemnités journalières pour son personnel en cas d'incapacité de travail, les principes régissant l'appréciation du rapport médical sont les mêmes qu'en matière d'assurances sociales. Le juge instruisant d'office en application de l'art. 19 LPA par renvoi de l'art. 89A LPA, il lui appartient d'ordonner l'apport d'autres preuves lorsque cela est nécessaire pour pouvoir trancher utilement le litige. Dès lors que le rapport du médecin-conseil est complet compte tenu des droits contestés, qu'il est fondé sur des examens approfondis, qu'il tient compte des affections dont se plaint l'intéressée, qu'il a été établi en connaissance de l'anamnèse de la patiente et que l'exposé du contexte médical est cohérent, il n'y a pas lieu d'administrer d'autres preuves".
