The court held that an intermediary agent who caused a serious traffic accident, fled, and then tried to simulate a vehicle theft no longer satisfied the statutory honorability requirement. The appeal against the withdrawal of authorization was therefore dismissed, and the administrative measure was upheld.
Art. 3 lit. d LAI; withdrawal of authorization for lack of honorability: the statutory requirement of honorability must be fulfilled continuously. Serious conduct incompatible with the trust demanded by the activity, in particular causing a grave accident, fleeing the scene, and subsequently attempting to conceal the facts by a false theft narrative, constitutes a clear breach of honorability and justifies withdrawal of the authorization.
