A taxpayer domiciled abroad and owning an immovable property in Geneva challenged the cantonal tax assessment. The court held that, under Art. 14(1) LCP, such a taxpayer is taxed at the rate applicable to total income and wealth. It further held that Arts. 29 and 44 LCP on mortgage debt and related interest do not qualify as lex specialis overriding that rule. The administration may also apply a later interpretive directive if it is more favorable than a maximum-rate taxation where the taxpayer refuses to disclose worldwide income and wealth.
