Seuls le droit d'être entendu, le principe de proportionnalité et celui de l'interdiction de l'arbitraire doivent être examinés par le TA dans le cas du licenciement d'un employé en période probatoire. Le Code des Obligations ne s'applique plus à titre supplétif, depuis la novelle de 1987. Le licenciement d'un employé en période probatoire est uniquement soumis au droit public et doit respecter les droits et principes constitutionnels, tels que le droit d'être entendu, l'égalité de traitement, l'interdiction de l'arbitraire et la proportionnalité.
