Résumé Omnilex

The TA allowed the appeal against the refusal to authorize a restaurant terrace. It held that the measure did not achieve its public-order purpose because the neighborhood complaints related mainly to noise from an indoor gaming room rather than the terrace itself. The police report was favorable to the terrace and did not establish that its use would disturb the residents' tranquility. The refusal was therefore disproportionate under Article 13 LEDP.

Regeste Omnilex

LEDP art. 13; public-domain use and authorization for a restaurant terrace; proportionality. A refusal to authorize use of public property must be based on concrete disturbances attributable to the requested use and must be suitable and necessary to achieve the public-order objective. Where the complaints concern other sources of nuisance, and the competent police report does not show adverse effects from the terrace itself, the refusal is disproportionate and cannot be upheld (consid. implicit).

Question juridique clé

Whether the refusal to authorize a restaurant terrace was lawful under Article 13 LEDP.

Solution extraite

The refusal was unlawful because it did not concretely further the stated public-order aim and was not proportionate in light of the actual source of disturbances.

Motifs extraits

The residents' complaints concerned mainly noise from the indoor gaming hall, not the terrace. The gendarmerie report supported the terrace and did not show that its use would disturb public tranquility.
