The insured sought coverage from his health insurer for rehabilitation treatment undergone in France after a knee lesion. The court held that the treatment was not an emergency and that comparable care was available in Switzerland. It therefore denied mandatory coverage under Art. 34(2) LAMal and dismissed the appeal.

Mandatory health insurance does not have to assume costs for planned foreign treatment that is neither emergency care nor otherwise justified by unavailability of appropriate care at home. The decisive factors are the absence of urgency and the objective possibility of obtaining the medically indicated treatment in Switzerland; a subjective preference for foreign treatment is insufficient. Good-faith considerations do not override the statutory limitation on foreign coverage in the absence of specific assurances.
