The court addressed standing to seek reopening of a criminal proceeding that had ended by final dismissal order. Aus den Erwägungen:

Der Angeschuldigte und der Staatsanwalt können die Wiederaufnahme eines durch Aufhebungsverfügung rechtskräftig beendeten Strafverfahrens beantragen (Art. 248 i.V.m. Art. 249 StP). Nach Art. 249 StP ist der Strafkläger nicht legitimiert, die Wiederaufnahme zu verlangen (vgl. auch GVP 1989 Nr. 65). Hingegen sind die gesuchstellenden Eltern als Hinterbliebene des mutmasslichen Opfers gestützt auf das Opferhilfegesetz zur Einreichung des ausserordentlichen Rechtsmittels der Wiederaufnahme des rechtskräftig aufgehobenen Strafverfahrens legitimiert (Art. 2 Abs. 2 lit. b i.V.m. Art. 8 Abs. 1 lit. c OHG; Steiger-Sackmann, OHG-Kommentar, 2005, Art. 8 OHG N 111).
