2.   Mit der Ausweisung des Beklagten aus der Wohnung und der Räumung derselben ist der eingeklagte Rückgabeanspruch nach Art. 267 Abs. 1 OR untergegangen, weshalb das Verfahren in der Sache gegenstandslos geworden ist.

3.   Es stellt sich noch die Frage, ob das Verfahren nunmehr, wie von Art. 242 ZPO vorgesehen, ohne Weiteres abzuschreiben ist, oder ob der Beschwerdeführer, dem die Mietsache während der Pendenz des Beschwerdeverfahrens gegen seinen Willen entzogen worden ist und dem ein Interesse an der Überprüfung der Rechtmässigkeit des angefochtenen Entscheides grundsätzlich ohne weiteres zuzubilligen ist, einen Anspruch auf eine solche Überprüfung noch im vorliegenden Verfahren habe oder ob er mit seinen allfälligen Schadenersatzansprüchen auf den Weg eines separaten Prozesses zu verweisen sei.

Ersteres ist allerdings schon deshalb zu verneinen, weil der Beklagte mit seiner Eingabe vom 17. Oktober 2014 die Beschwerdefrist von zehn Tagen (Art. 321 Abs. 2 ZPO), welche einen Tag nach Zustellung des Entscheides, d.h. am 1. Oktober 2014 zu laufen begann und am 10. Oktober 2014 endete (Art. 142 Abs. 1 ZPO), verpasst hat. Auf seine Beschwerde könnte daher selbst dann, wenn die Ausweisung noch nicht vollzogen und das Verfahren in der Sache noch nicht gegenstandslos geworden wäre, nicht eingetreten werden. Umso weniger kommt eine Überprüfung der Rechtmässigkeit der Ausweisung im Abschreibungsbeschluss in Frage. Da die Sache, wie soeben festgestellt wurde, mittlerweile – d.h. seit 11. Oktober 2014 – wegen Verpassens der Beschwerdefrist in Rechtskraft erwachsen, d.h. rechtskräftig entschieden ist, fehlt es an der Prozessvoraussetzung von Art. 59 Abs. 2 lit. e ZPO. Daran ändert sich selbst dann nichts, wenn man dem Beschwerdeführer ein schutzwürdiges Interesse im Sinne der Prozessvoraussetzung von Art. 59 Abs. 2 lit. a ZPO zubilligen wollte.
