Résumé Omnilex

The court addressed the method for calculating post-marital maintenance. It held that no single calculation method is mandatory and that courts enjoy broad discretion. In the circumstances, the basic-needs method with equal sharing of surplus was considered the most suitable approach, especially because the parties’ financial situation was only slightly below average and child-care maintenance remained due. The court further stated that the maintenance debtor must always retain the minimum subsistence level; any shortfall must be borne by the maintenance creditor.

Regeste Omnilex

Art. 125 ZGB; method of calculating post-marital maintenance and protection of the maintenance debtor’s minimum subsistence. The court is not bound to a specific maintenance calculation method and enjoys broad discretion. In a factual setting of slightly below-average means with continuing child-care maintenance, the basic-needs method with equal sharing of surplus is particularly suitable because it reflects separation-related additional costs, preserves the marital standard of living as far as possible, and treats the homemaking and earning spouse equally. The maintenance debtor must in all events retain the existence minimum; any shortfall is borne by the maintenance creditor (consid. 2).

Question juridique clé

Which method should be used to calculate post-marital maintenance?

Solution extraite

The court is not bound to any fixed calculation method and has broad discretion; in the present circumstances, the basic-needs method with equal sharing of surplus was appropriate.

Motifs extraits

That method best fits slightly below-average financial circumstances and ongoing child-care maintenance. It accounts for separation-related extra costs, preserves the former marital standard of living for both spouses as far as possible, treats the homemaking and earning spouses equally, and is clear and comprehensible.

Question juridique clé

May the maintenance debtor retain his or her own minimum subsistence level?

Solution extraite

Yes. The maintenance debtor must always retain the necessities of life; the debtor’s own minimum subsistence level may not be invaded.

Motifs extraits

If there is a shortfall, it must be borne by the maintenance creditor, not by reducing the debtor below the protected existential minimum.
