Where the warning is missing, the court need not decide whether a particular day constitutes a locally recognized public holiday (consid. 1).

SOG 2011 Nr. 11 ** Art. 143 Abs. 3 und 145 ZPO.** Parteien sind zwingend darauf hinzuweisen, dass im summarischen Verfahren der Fristenstillstand nicht gilt. Sonst wird die betreffende Frist ausnahmsweise vom Fristenstillstand erfasst. Die Frage, ob der Ostermontag ein lokaler Feiertag sei, der den Fristenlauf beeinflusst, wurde offen gelassen. * Sachverhalt:* Der Gerichtspräsident erliess am 13. April 2011 vorsorgliche Massnahmen und hob die für die Dauer des Ehescheidungsverfahrens erlassenen vorsorglichen Massnahmen auf. Der Ehemann erhob dagegen am 26. April 2011 Berufung. Die Zivilkammer tritt auf die Berufung ein, obwohl diese möglicherweise zu spät eingereicht worden ist. * Aus den Erwägungen:* 1. Die Verfügung vom 13. April 2011 wurde dem Ehemann am 14. April 2011 zugestellt. Die zehntägige Berufungsfrist begann somit am 15. April zu laufen und endete am Ostersonntag, 24. April 2011. Weil der letzte Tag der Frist somit auf einen Sonntag fällt, endet sie nach Art. 142 Abs. 3 Zivilprozessordnung (ZPO, SR 272) am nächsten Werktag. Ob der Ostermontag ein «am Gerichtsort vom Bundesrecht oder vom kantonalen Recht anerkannter Feiertag» sei und die Frist somit eingehalten wäre, weil sie in diesem Fall erst am Dienstag, 26. April 2011 enden würde und somit eingehalten wäre, kann offengelassen werden. Die Berufungsfrist muss nämlich aus einem anderen Grund als ohnehin eingehalten betrachtet werden: Das vorliegende Verfahren betreffend vorsorgliche Massnahmen im Ehescheidungsprozess ist ein summarisches. Für das summarische Verfahren gilt der Fristenstillstand grundsätzlich nicht (Art. 145 Abs. 2 lit. b ZPO). Auf diese Besonderheit sind die Parteien aber ausdrücklich hinzuweisen (Abs. 3 von Art. 145 ZPO). Diesen Hinweis hat der Gerichtspräsident nun aber in seiner Rechtsmittelbelehrung zur Verfügung vom 13. April 2011 unterlassen. Deshalb muss die Rechtsmittelfrist (ausnahmsweise) als eingehalten betrachtet werden. * Obergericht Zivilkammer, Urteil vom 15. Juni 2011 (ZKBER.2011.31)*
